This monograph is devoted to the study of a complex of problems concerning the socio-legal conditionality of the composition of fraud in the field of lending and the validity of the application to persons who have committed fraudulent acts of this type, criminal encouragement in connection with their positive post-criminal behavior. The assessment of the validity of the differentiation of liability for fraud in the field of lending made by the legislator through the construction of the composition described in Article 1591 of the Criminal Code of the Russian Federation is given. The theoretical approaches to the practical implementation of the grounds established by the legislator for the application of criminal law encouragement of positive post-criminal behavior in relation to the perpetrators of the relevant crimes are specified.
