Saving a business in bankruptcy law. Report of the Institute of European Law
The report "Saving Business in Bankruptcy Law" is the result of many years of work carried out under the auspices of the European Institute of Law under the leadership of Professors Bob Wessels and Stefan Madaus with the support of Gert-Jan Boon, aimed at generalizing and developing unified approaches to business recovery. The research project is characterized by a wide coverage of involved experts from most European countries (Austria, Belgium, England and Wales, France, Germany, Greece, Hungary, Italy, Latvia, the Netherlands, Poland, Spain, Sweden) and contains up-to-date information on rehabilitation procedures in each of the listed legal systems. Based on the relevant generalization, the working group has derived more than 100 recommendations, in particular regarding: participants and the structure of the procedure, rescue financing, ongoing contracts, the order of satisfaction of creditors' claims, contesting transactions, labor and pension relations, business sales on the move, restructuring plan, groups of companies and small and medium-sized businesses. The report may be useful to lawyers and other specialists dealing with and (or) interested in bankruptcy law issues, including rehabilitation and restructuring issues, in scientific, law enforcement, consulting and legislative activities.
