Spravedliviy sud glazami ESPCH.Analiz praktiki Evropeyskogo Suda po pravam cheloveka.Chast 1
With Russia's accession to the European Convention for the Protection of Human Rights in 1998, Russian citizens had another instance to combat injustice — an appeal to the European Court of Human Rights (ECHR). However, not every complaint is accepted — most of the statements are rejected by the ECHR as unfounded. This happens primarily because the applicants are not aware of the approaches and evaluation criteria that the ECHR uses when selecting complaints for consideration. Having more than 20 years of law practice and extensive experience in applying to the ECHR, the author of this work, which is the first book in the trilogy "A Fair Trial through the eyes of the ECHR", draws attention to the non-standard approach of the judges of the European Court to issues that, at first glance, can not even cause doubts in any lawyer. But it turns out that the ECHR thinks differently. The book examines the precedents of the European Court of Justice, identifies trends and principles of decision-making on criminal law issues. The second and third parts, in turn, will be devoted to civil law aspects and property issues.
